KHAMILA® FURNITURE AND UPHOLSTERY LIMITED WARRANTY

ALL WARRANTY PERIODS INDICATED IN THIS WARRANTIES BEGIN ON THE DATE THAT  YOU ARE NOTICED BY E-MAIL, MAIL, PHONE, TEXT MESSAGE OR IN PERSON THAT THE FURNITURE IS/ARE READY FOR DELIVERY TO YOU. AND TERMINATES IN THE EVENT THAT THE PRODUCT IS TRANSFERRED BY THE ORIGINAL RETAIL PURCHASER TO ANOTHER PARTY. KHAMILA® FURNITURE WARRANTIES DO NOT COVER PRODUCTS SOLD “AS IS”, FLOOR SAMPLES, CLOSEOUTS, PURCHASED FROM A SOURCE OTHER THAN KHAMILA® FURNITURE BOUTIQUES, USED IN A COMMERCIAL OR NONRESIDENTIAL SETTING OR SHIPPED OUTSIDE THE U.S. BY YOU OR A FREIGHT FORWARDER. ANY PRODUCT MODIFICATION, ALTERATION OR REPLACEMENT MADE BY THE CONSUMER OR ANY OTHER COMPANY OR SERVICE PROVIDER, VOIDS THIS WARRANTY.

BECAUSE OF THE NATURAL VARIATIONS IN WOOD, LEATHER, STONE, MINERALS, WOOD VENEERS, FABRICS AND THE HAND FINISHING TECHNIQUES USED TO CREATE MANY KHAMILA® FURNITURE PRODUCTS, FINISH COLORS, TEXTURE, GRAIN AND SIZES MAY VARY FROM PIECE TO PIECE. THESE WARRANTIES DO NOT COVER SUCH VARIATIONS OR ANY DIFFERENCES BETWEEN FLOOR SAMPLES, SWATCHES OR PRINTED ILLUSTRATIONS AND YOUR ITEM(S). KHAMILA® FURNITURE IS ALSO NOT RESPONSIBLE FOR COLOR VARIATIONS IN FABRIC OR LEATHER UPHOLSTERY DUE TO DYE LOT VARIATIONS THAT MAY OCCUR WITH NOT CONCURRENT ORDERS.

FURNITURE WARRANTY

Khamila® Furniture products warrants its wood, MDF, metal, stone, minerals products to be free from non-natural defects in material and craftsmanship under residential and normal use for a period of two (2) years from the date of the delivery; however, certain components of the wood, stone, metal and veneers  products are subject to shorter warranty periods which are described below. Furniture in which such defects occur will be repaired or replaced at Khamila’s option or, if replacement or repairs are not possible, alternate financial remuneration may be paid at Khamila’s option. This remedy is exclusive and Khamila® Furniture does not authorize any person to create for it any other obligation or liability in connection with this piece(s) of furniture.

This warranty applies under normal residential usage only and does not apply to damages or defects resulting from exposure to direct sunlight or powerful lamps; exposure to sources of heat such as fireplaces heaters or radiators; exposure to solvents, alcohol, vomit, chemicals and/or liquids; pets saliva, pets skin oil/grease, pets nails/teeth scratches; negligence, abuse or misuse; inadequate or improper maintenance, cleaning or care; accidents or non professional handling/moving/shipping;  any use for which the product was not designed; commercial usage, which includes rental, business, commercial, institutional or other non-residential use.

Khamila® Furniture products are made of naturally variable raw materials. Differences in grain character and color among wood, leather, art leather, glass, stones and minerals are naturally occurring variations and are not within the control of the manufacturer nor considered defects under this warranty. Natural color changes, variations, or movements in lumber or veneer products, and exposure to extreme temperature changes and direct sunlight, may cause color changes and/or surface damage and are not covered by this warranty.

Khamila® Furniture products warrants the stone and mineral components of its products to be free from defects in workmanship for a period of one (1) year from the date of delivery. This warranty excludes stains caused by beverages, food, solvents, alcohol, vomit, chemicals and/or liquids; visible or deep veining; dents, cracks and scratches caused by improper handling, lifting or moving.

Khamila® Furniture products sometimes use common and exotic veneers which are taken from areas of the tree that grow in different directions. This natural characteristic of the veneer causes tension and pulls the fibers of the wood, which can result in hairline cracks over time. This condition is considered an enhancement to the product and is excluded from this warranty.

Fabrics/Leathers/Art-Leather: Khamila® Furniture products warrants the fabrics, leathers, art leathers, cushions and filling materials applied to its products to be free from defects in material and workmanship for a period of one (1) year from the date of delivery. Any type of fabric/leather protectant or treatment not applied by the fabric/leather manufacturer voids the warranty. Pilling is a characteristic of fabrics resulting from normal use and wear and is not covered under any warranty. Improper cleaning voids any warranty.

Khamila® Furniture products sometimes use not tempered glass in dining tops with a thickness between 1/2” and 3/4”; some of this glass tops may contain minor surface and bevel finish variations, tiny bubbles and almost non-visible scratches caused by the packaging or handling, which are considered normal and are not defects.

UPHOLSTERY WARRANTY

This warranty applies to Khamila® Furniture upholstery products under normal residential usage only, and does not apply to damages or defects resulting from exposure to direct sunlight or powerful lamps; exposure to sources of heat such as fireplaces heaters or radiators; exposure to solvents, alcohol, vomit, chemicals and/or liquids; pets saliva, pets oil/grease skin/hair, pets nails/teeth scratches; negligence, abuse or misuse; inadequate or improper maintenance, cleaning or care; accidents or non professional handling/moving/shipping;  any use for which the product was not designed; commercial usage, which includes rental, business, commercial, institutional or other non-residential use. Re-covering the frame voids all warranties because in re-covering, some or all components may be changed.

Frames and Springs: Khamila® Furniture warrants to you, the original retail purchaser, protection against manufacturing defects of frames for five (5) years and springs for three(3) years.  This warranty applies as long as the product remains upholstered in the original fabric and is used under normal wear in normal conditions.

Cushion: Khamila® Furniture warrants you, the original retail purchaser, protection against abnormal loss of resiliency of the upholstered furniture, for two (2) years. Abnormal wear and abnormal loss of resiliency should not be confused with softening and flattening of the foam and fibers, which are considered normal wear, and are not defects.

Filling Materials: Khamila® Furniture warrants to you, the original retail purchaser, protection against loss of resiliency of filling materials for two (2) years. Compressing of polyester and feathers with use is not considered loss of resiliency. From time to time, your upholstered furniture will need “fluffing up” as any upholstered furniture should be regulated with use.

Fabrics: Are warranted only on visible manufactured defect. Since manufacturers of upholstery fabrics do not guarantee their products for wearing quality, color-fastness, shrinkage, wrinkling and stretching, those properties are not covered under this warranty.

Leathers: Leather is a natural material, every hide uniquely enhanced by natural features. Wrinkles, scratches, insect bites, healed scars and other natural markings should not be considered defects. Color variations occur normally within a hide and from hide to hide as no two hides are alike.

Since leather manufacturers do not guarantee their products for wearing quality, color-fastness, shrinkage, wrinkling and stretching, those properties are not covered under this warranty. Leather is a natural material, every hide uniquely enhanced by natural features. Wrinkles, scratches, insect bites, healed scars and other natural markings should not be considered defects. Color variations occur normally within a hide and from hide to hide as no two hides are alike.

This warranty also does not cover fabric protectors that have not been applied by the fabric manufacturer, since they may cause latex deterioration, seam slippage, discoloration and may damage filler materials.

WARRANTY LIMITATIONS AND EXCLUSIONS

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. KHAMILA® FURNITURE WILL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES, EVEN IF IT HAS REASON TO KNOW IN ADVANCE THAT THEY ARE POSSIBLE.

Some states do not allow the exclusion of implied warranties or the limitation of damages, so the above exclusions and limitations may not apply to you.
